Product or technology will not be imported, reexported or transferred to be used in the design, development, production, stockpiling, or use of chemical or biological weapons and their precursors. (15 CFR 744.4, 744.6)
Product or technology will not be imported, reexported or transferred to be used in the design, development, production, stockpiling, or use of rocket systems or unmanned air vehicles. [The term “rocket system” includes buts is not limited to: ballistic missile systems, space launch vehicles, and sounding rockets. “Unmanned air vehicles” include cruise missile systems, target drones, and reconnaissance drones] (15 CFR 744.3, 744.6)
Product or technology and/or replicas* thereof will not be used (either directly or indirectly) in sensitive nuclear end-uses, as follows: (15 CFR 744.2)
Nuclear explosive activities: Nuclear explosive activities, including research on or development design, manufacture, construction, testing, or maintenance of any nuclear explosive device, or components or subsystems of such a device.
Unsafeguarded nuclear activities: Activities including research on or development, design, manufacture, construction, operation or maintenance of any nuclear reactor, critical facility, facility for the fabrication of nuclear fuel, facility for the conversion of nuclear material from one chemical form to another or separate storage installation, where there is no obligation to accept International Atomic Energy Agency (IAEA) safeguards at the relevant facility or installation when it contains any source of special fissionable material (regardless of whether or not it contains such material at the time of export), or where any such obligation is not met.
3) Safeguarded and unsafeguarded nuclear activities: Safeguarded and unsafeguarded nuclear fuel cycle activities, including research on or development, design, manufacture, construction, operation, or maintenance of any of the following facilities, or components for such facilities for the:
Facilities for the chemical processing of irradiated special nuclear or source material:
Facilities for the production of heavy water;
Facilities for the separation of isotopes or source and special nuclear material; or
Facilities for the fabrication of nuclear reactor fuel containing plutonium.
* Replicas refers to items produced abroad on physical examination of the item originally exported, matching it in all critical design and performance parameters.
Will not be imported, reexported or transferred to be used in the design, development, production, construction, support, or maintenance of a maritime nuclear propulsion project; including any machinery, devices, components or equipment specifically developed or designed for use in such plants or facilities. Product, technology or software will not be imported, re-exported or transferred to be used in crime control and detection commodities and end-uses. (15 CFR 742.7)
Product will not be imported or reexported to destinations embargoed by the U.S. government (unless parts and components exemptions apply.) Product will not be re-exported to entities listed on U.S. government denial lists: U.S. Department of Commerce Denied Persons List (http://www.bis.doc.gov/complianceandenforcement/liststocheck.htm ), Unverified List "http://www.BIS.doc.gov/Enforcement/UnverifiedList/Unverified_Parties.html" http://www.BIS.doc.gov/Enforcement/UnverifiedList/Unverified_Parties.html) and U.S. Department of Treasury Specially Designated Nationals List http://www.treas.gov/offices/enforcement/ofac/sdn/t11sdn.pdf (15 CFR 744.16, 764 supp. 2 & 3)
Product will not be imported or reexported for use by the end-users listed on the Entity List http://www.access.gpo.gov/bis/ear/pdf/744spir.pdf, Supplement No. 4, Part 744 of the EAR without approval from the U.S. Department of Commerce. (15 CFR 744.1,b,2,c)
“Effective September 6, 2006, a license is required to export or reexport any item subject to EAR to these entities related to Mayrow General Trading, as follows: Akbar Ashraf Vaghefi; Neda Overseas Electronics L.L.C.; Mostafa Salehi; IKCO Trading GmbH; Pyramid Technologies; A.H. Shamnad; S. Basheer; Hamed Athari; and Mayrow Technics Co. All entities related to Mayrow General Trading described ‘herein’ are located in Dubai, United Arab Emirates; except for Akbar Ashraf Vaghefi (located in Germany and Dubai, United Arab Emirates) and IKCO Trading GmbH (located in Germany). Written authorization will be obtained from the Bureau of Industry and Security prior to reexporting the items or technology, unless they are destined to Canada or would be eligible for export from the United States to the new country of destination under “NLR” based on the Country Chart.
Product will not be used, sold, resold, delivered, or retransferred, directly or indirectly contrary to U.S. export control regulations.
Will not be re-exported to for use by persons who commit, threaten to commit or support terrorism. The term terrorism means an activity that: (Legal Authority for the EAR, part IV.11)
Involves a violent act or an act dangerous to human life, property, or infrastructure; and
Appears to be intended:
1) to intimidate or coerce a civilian population;
to influence the policy of a government by intimidation or coercion; or
to affect the conduct of a government by mass destruction, assassination, kidnapping or hostage taking.
Product specially designed or modified for military / satellite / space end-use may require an export license from the U.S. Department of State.
